{"id":5564,"date":"2017-11-07T07:53:25","date_gmt":"2017-11-07T10:53:25","guid":{"rendered":"http:\/\/employer.com.br\/blog\/?p=5564"},"modified":"2018-04-26T17:16:40","modified_gmt":"2018-04-26T20:16:40","slug":"horas-in-itinere-pos-reforma-trabalhista","status":"publish","type":"post","link":"https:\/\/traveloffice.com.br\/blog\/horas-in-itinere-pos-reforma-trabalhista\/","title":{"rendered":"Como ficam as horas in itinere com a Reforma Trabalhista?"},"content":{"rendered":"<blockquote>\n<h4 class=\"p1\"><strong><span class=\"s1\">Entre os mais de cem pontos alterados pela Lei n\u00ba 13.467\/2017 est\u00e1 a altera\u00e7\u00e3o do <\/span><span class=\"s2\">\u00a7 2\u00ba, do art. 58 da CLT, referente \u00e0s horas <i>in itinere. <\/i><\/span><span class=\"s1\">Vamos ver o que mudou?<\/span><\/strong><\/h4>\n<\/blockquote>\n<p><iframe src=\"https:\/\/www.youtube.com\/embed\/fznVodvS04M\" width=\"560\" height=\"315\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><\/iframe><\/p>\n<p class=\"p1\"><span class=\"s2\"><b>Regra atual<\/b><\/span><\/p>\n<p class=\"p1\"><span class=\"s2\">O artigo da CLT referente \u00e0s horas <i>in itinere<\/i> ainda est\u00e1 vigente, j\u00e1 que as modifica\u00e7\u00f5es trazidas pela Reforma Trabalhista somente come\u00e7ar\u00e3o a valer a partir de 11 de novembro deste ano. Ele determina que o tempo de deslocamento do empregado, no itiner\u00e1rio casa-trabalho e trabalho-casa, deve ser contabilizado como tempo integrante da jornada de trabalho. Mas isto se, e somente se: <\/span><\/p>\n<p class=\"p1\"><span class=\"s2\">&#8211; o local de trabalho seja de dif\u00edcil acesso <b>ou<\/b> n\u00e3o servido por transporte p\u00fablico regular (requisito 01); <b>e<\/b><\/span><\/p>\n<p class=\"p1\"><span class=\"s2\">&#8211;<span class=\"Apple-converted-space\">  <\/span>o empregador forne\u00e7a transporte para o deslocamento (requisito 02).<\/span><\/p>\n<p class=\"p1\"><span class=\"s2\">Se esses 02 requisitos estiverem presentes, todo o tempo de deslocamento ser\u00e1 somado \u00e0s horas de efetivo trabalho.<\/span><\/p>\n<p class=\"p1\"><span class=\"s2\">Imaginemos que o empregado trabalhe em zona rural e at\u00e9 o local de trabalho n\u00e3o existe transporte p\u00fablico. Ent\u00e3o, o empregador fornece esse transporte, todos os dias ele gasta 02 horas para ir e voltar do trabalho e chegando l\u00e1 ainda trabalha 08 horas por dia.<\/span><\/p>\n<p class=\"p1\"><span class=\"s2\">Pela atual reda\u00e7\u00e3o do \u00a7 2\u00ba, do art. 58 da CLT, a jornada di\u00e1ria desse empregado \u00e9 de 10 horas (02 horas <i>in itinere<\/i> + 08 horas de efetivo trabalho), tendo direito a receber 02 horas extras <i>in itinere <\/i>por dia<i>.<\/i><\/span><\/p>\n<p class=\"p1\"><span class=\"s2\">Mas preste aten\u00e7\u00e3o: se esse mesmo empregado trabalhar 06 horas por dia n\u00e3o ter\u00e1 direito a receber horas extras <i>in itinere, <\/i>pois somando o tempo de deslocamento di\u00e1rio (02 horas <i>in itinere<\/i>) mais as horas de efetivo labor (06 horas), ele ter\u00e1 uma jornada de 08 horas por dia.<\/span><\/p>\n<p class=\"p1\"><span class=\"s2\"><b>Nova regra<\/b><\/span><\/p>\n<p class=\"p1\"><span class=\"s2\">Desde 11 de novembro de 2017, com a vig\u00eancia da Lei da Reforma Trabalhista, o empregador n\u00e3o mais precisar\u00e1 se preocupar com a contagem, controle e pagamento das horas <i>in itinere<\/i>, pois elas n\u00e3o mais existir\u00e3o. Foram extintas pela reforma! Vamos entender melhor essa mudan\u00e7a.<\/span><\/p>\n<p><iframe src=\"https:\/\/www.youtube.com\/embed\/Jgp71jV4fE4\" width=\"560\" height=\"315\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><\/iframe><\/p>\n<p class=\"p1\"><span class=\"s2\">Voltando ao exemplo anterior. Aquele empregado que atualmente tem direito a receber 02 horas extras <i>in itinere<\/i> por dia, com as novas regras n\u00e3o ter\u00e1 mais direito a elas. Isto porque independentemente do local do trabalho e do meio de transporte por ele utilizado para ir e voltar do trabalho, o tempo gasto para o deslocamento casa-trabalho e vice-versa n\u00e3o ser\u00e1 considerado como tempo \u00e0 disposi\u00e7\u00e3o do empregador. Portanto, n\u00e3o ser\u00e1 computado na jornada de trabalho.<\/span><\/p>\n<p class=\"p1\"><span class=\"s2\">Estas s\u00e3o as principais informa\u00e7\u00f5es sobre a altera\u00e7\u00e3o do Art. 58 da CLT dada pela <strong><a href=\"http:\/\/employer.com.br\/blog\/10-pontos-de-discussao-sobre-reforma-trabalhista\/\">nova reda\u00e7\u00e3o que rege as leis trabalhistas.<\/a><\/strong> \u00c9 fundamental organizar as informa\u00e7\u00f5es do RH para preparar a rotina dos trabalhadores de acordo com as novas regras.<\/span><\/p>\n<p class=\"p1\"><span class=\"s2\"><b>Ainda tem d\u00favidas sobre a extin\u00e7\u00e3o horas <i>in itinere<\/i>?
